Please join FRAC in urging USDA to halt SNAP purchase restrictions.
USDA’s Food and Nutrition Administration (FNA) posted notices on September 15, 2026, requesting public comments on SNAP restriction demonstration projects. To date, USDA has approved 23 state waivers that restrict the purchase of certain foods and/or beverages with SNAP benefits, although a federal court invalidated the approvals for five states. The focus of the current FNA requests for public comment relate to the remaining 18 states.
Advocates and other stakeholders have an important opportunity to weigh in on the impact of these demonstration projects on SNAP participants, retailers, and agencies. According to the notices, “FNA is particularly interested in comments regarding the state’s implementation and operation of the demonstration project.” While the notices are similar in structure and content, each of the 18 states has a separate notice and comment link on Regulations.gov.
Individuals and local organizations should submit comments for their own states. Because USDA is required to consider the comments for each notice independently when making decisions about the waiver in that state, national groups and other stakeholders should submit comments for as many of the 18 notices as possible.
All public comments are due on October 15, 2026.
